Governing Law



The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Having agreed a hiring with us, you are liable to pay any fees due under that agreement on or before the date specified. Where no date is specified, the whole outstanding balance of any agreed fee is due on completion of the event. Late payment is subject to a 5% surcharge per day after payment is due, unless late payment is agreed with us in writing before hand.

We have never cancelled or failed to turn up at an event we have been engaged to cover. In the unprecedented event that we cannot fulfil an engagement, our liability is limited to the cost of arranging alternative hire, subject to a maximum of the fee we have agreed with you. We cannot accept liability for any other direct or consequential losses.

We are constantly improving the systems and equipment available. The equipment provided may not be exactly as specified in the original quote (although it will be equivalent to or better than the equipment specified). If it is essential to you that a particular item is exactly as specified it is the duty of the hirer to ensure they inform us of this before they agree a hiring. Any contract of hire subsisting between us includes only such apparatus as is specified therein. Whilst every endeavour will be made to supply apparatus as ordered, we reserve the right to substitute other designs without giving prior notice.

All equipment we supply is fully operational and in good condition. Our equipment is also well-maintained and of professional standard. Our engineers carry basic repair tools. Catastrophic equipment failure is unusual and unlikely. However, we cannot accept liability for any direct or consequential losses arising from equipment failure. Our liability in respect of any defect or failure of the apparatus supplied is limited by making good or replacement or repair defects which under proper use and conditions appear therein and arise solely from faulty design materials or workmanship. We do not represent or warrant that apparatus supplied by its capacity or performance or us are fit for the purpose for which you require it. We are not to be held liable for stoppages or any consequential loss or damage arising out of work done or services rendered under any contract of hire.

The Hirer during the continuance will not sell or offer for sale, assign, mortgage, pledge, underlet, lend or otherwise deal with the equipment or any parts thereof in a manner prejudicial to the Owner's rights, but will keep the equipment in its possession and will not remove the same or any part or parts thereof from the place where the equipment is for the time being without the previous consent of the Owner and will duly and punctually pay all rents, rates, taxes, charges and impositions payable in respect thereof on demand and will protect the same against distress, execution or seizure and indemnify the Owner against all losses, costs, charges, damages and expenses incurred by it by reason or in respect thereof.

Where equipment is used without our supervision, we check the condition and operation of all items before they leave us. On accepting delivery you agree that an item is in good condition and fully operational. The Hirer shall use the equipment in a skilful and proper manner and shall at its own expense keep the equipment in good and substantial repair and condition, reasonable wear and tear expected, and keep the same insured against fire, loss, damage or risk from whatever cause arising in the full replacement value thereof including a year's loss of hire in some insurance office or offices of repute and will permit the Owner at all reasonable times to have access to the equipment and to inspect the state and condition thereof. During the period of hire all equipment is the responsibility of the hirer and all damage to any goods is the responsibility of the hirer. Our engineer will provide a quote for any subsequent repairs required which shall be borne by the hirer. Should a product be damaged beyond economical repair a charge for the replacement of the same equipment (or equivalent specification) shall be met by the hirer.

The owner cannot accept responsibility for crowd control at any event, or for the safety or security of any hirer's or third party's premises, and a hirer is wholly liable to us for the cost of any damage to or theft of our equipment from a third party at the performance site.

Although our equipment is electrically safe and well-maintained the performance site's electricity supply may not be. It is the hirer's responsibility to ensure provision of a safe (240 volt AC, 32 amp or 13 amp) supply. Where portable generators are used, these must be regulated and adequately grounded. Please contact us if you are unsure about what power will be required. WE CANNOT AND WILL NOT USE AN UNSAFE SOCKET OR POWER SUPPLY. Equipment damaged or destroyed due to unsafe electrical equipment at the performance site shall be repaired or replaced at the expense of the hirer.

Force Majeure: we will not be liable for any failure to supply a product or service where that failure is wholly caused by an event we could not reasonably foresee, forestall or prevent. This may include (but is not limited to) acts of war, terrorism, or natural disasters.

No responsibility shall be accepted by the Owner for any equipment not belonging to the owner whether delivered by the Owner or not and the Hirer will indemnify the Owner against any damage to the equipment supplied by the Owner as a result of malfunction or non function of any equipment or installations not belonging to the Owner.

Third parties (i.e. live bands etc) create sound pressure levels that are neither appropriate nor safe. Quieter instruments and vocals can be amplified through the public address system to produce equivalent levels for the "mix". HIGH SOUND PRESSURE LEVELS CAN CAUSE PERMANENT HEARING DAMAGE. Repeated exposure can have a cumulative effect. Although our equipment can and does produce high enough sound pressure levels to cause hearing damage, we cannot accept liability for any individual's failure to stay at an appropriate distance from loudspeakers or take any necessary steps to protect their own hearing. It is the responsibility of the hirer to ensure the safety, with regards to hearing, of the general public. Where appropriate you may wish to ensure that warning notices are displayed, hearing protection is issued, or safety barriers are erected.

The risk of feedback - also a potential cause of hearing damage - is inherent in monitor systems. Anyone in the performance area while monitors are in use is there at their own risk, it is the responsibility of the hirer to inform third parties of this.

It is the responsibility of the hirer to ensure there is adequate and safe access to a performance site. Our engineers will not put their personal health or the equipment in jeopardy trying to manoeuvre around obstacles (including stairs where the engineer believes they may cause injury). We reserve the right not to deliver equipment where we believe access to be unsafe, in such cases 50% of the hire charge is still payable by the hirer. It is the responsibility of the hirer to inform us beforehand of any access issues and where possible take appropriate measures to reduce risk to our engineers and equipment.

Any variation in the above conditions will require a specific written agreement from the Owner. Other terms and conditions may also apply (whether or not they form part of any written statement), but where no other written statement is available these terms will apply to any contract you may have with us. It is our responsibility to inform the hirer where to find these terms and conditions, it is the responsibility of the hirer to read them, any dispute of the terms and conditions by the hirer must be brought to our attention before hiring the goods. By agreeing to hire from us the hirer agrees to all of the terms and conditions listed above.
